Artist Emanuelle offers this website, including all information, content, features, tools, products, artwork, collectibles, and services available through this website, to you conditioned upon your acceptance of these Terms of Service.
Our online store is hosted and powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.
By visiting egartist.com, purchasing a product, creating an account, using our AI-assisted chat, submitting information, or otherwise accessing or using any part of the website, you agree to be bound by these Terms of Service and all policies incorporated into them by reference.
These Terms apply to all website visitors and users, including customers, collectors, browsers, vendors, merchants, and content contributors.
Please read these Terms of Service carefully before using our website. If you do not agree to these Terms, you should not access the website, use the Services, or purchase products from us.
Any new products, features, or tools added to the website will also be governed by these Terms of Service. We may update these Terms periodically by posting a revised version on this website. Your continued use of the Services after updated Terms are posted constitutes acceptance of those changes to the extent permitted by applicable law.
1. Eligibility and Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, territory, or country of residence. If you are not the age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian.

We reserve the right to refuse service, restrict access, cancel an order, or limit quantities to any person, geographic region, or jurisdiction when reasonably necessary and permitted by law.
You understand that information you submit through the website, excluding protected payment information, may be transmitted across different networks and modified to meet the technical requirements of connecting networks or devices. Payment information is encrypted during transmission through the applicable payment processor.
You may not reproduce, duplicate, copy, sell, resell, exploit, or commercially use any portion of the Services, website content, product photography, artwork, written material, designs, or access to the Services without our express written permission.
Section headings are included for convenience and do not limit or otherwise affect these Terms.
3. Products and Limited-Edition Artwork
Our products may include original artwork, art prints, signed prints, serialized pieces, copper art bars, collectible cards, and other limited-edition artist-created items.
Each piece involves hands-on artistic work, preparation, inspection, and careful packaging. Some products may be signed, numbered, serialized, personalized, handmade, hand-finished, or produced in limited quantities.
The specific contents, materials, dimensions, edition size, mintage, included accessories, and other product details will be stated in the applicable product listing. Only the items expressly identified in the product listing are included with a purchase.
Because many pieces are handmade or hand-finished, minor differences may occur between items. Variations in color, texture, positioning, finish, numbering, signature placement, copper tone, patina, surface appearance, or other details are natural characteristics of artist-created and collectible products. These reasonable variations are not defects.
Copper is a naturally reactive material and may tone, darken, spot, develop a patina, or otherwise change appearance over time due to exposure to air, moisture, oils, chemicals, handling, and storage conditions. These natural changes are not considered manufacturing defects.
Colors shown on electronic screens may differ from the colors of the physical product because of lighting, photography, display settings, and device differences.
We reserve the right to limit the sale of products or Services by person, household, order, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.
We may limit available quantities, discontinue a product, or close an edition without advance notice. Once a limited edition sells out, it will not be reproduced unless a product listing expressly states otherwise.
All product descriptions and availability are subject to correction before an order is accepted.
4. No Bulk or Wholesale Orders
EG Artist does not offer bulk or wholesale ordering. Our artwork and collectibles are not mass-produced merchandise. Each piece requires substantial time, hands-on work, care, precision, and emotional dedication.
We reserve the right to limit quantities or cancel orders that appear to be placed for unauthorized wholesale distribution, commercial redistribution, fraudulent activity, or circumvention of product limits.
This section does not restrict a lawful owner from privately transferring or reselling an authentic product after purchase, subject to applicable law. However, purchasing a physical product does not transfer any copyright, reproduction, manufacturing, licensing, or commercial-use rights in the underlying artwork or design.
5. Product Availability
Certain products may be available exclusively online through egartist.com and may be offered only in limited quantities.
Placing an item in your shopping cart does not reserve it. A product may sell out before checkout is completed.
We do not guarantee that any product, edition, serial number, or optional shipping service will remain available.
We reserve the right to discontinue any product or Service at any time. Any offer made through this website is void where prohibited by law.
6. Orders and Order Acceptance
Submitting an order does not automatically mean that we have accepted it. We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

Suspected fraud or unauthorized payment activity;

Violation of purchase limits;

Inability to ship to the provided destination;

If we cancel an order before fulfillment after payment has been collected, the amount collected for the canceled item will be returned through the original payment method, as required by applicable law. This merchant-initiated cancellation does not create a customer right to cancel a completed purchase.
Orders may not be combined, separated, redirected, or modified after they have entered processing.
You are responsible for reviewing your order carefully before completing checkout.
7. Billing and Account Information
You agree to provide current, complete, and accurate billing, shipping, payment, contact, and account information for every order.
You agree to promptly update your information when necessary so that we can complete your transaction and communicate with you regarding your order.
We are not responsible for delays, failed delivery, or losses caused by inaccurate, incomplete, outdated, or incorrectly entered customer information.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.
8. Prices and Payments
All prices are displayed in the currency shown at checkout and may change without notice.
The price charged for a product will be the price displayed at the time the order is submitted, subject to correction of genuine typographical, technical, or pricing errors.
Applicable taxes, shipping charges, customs duties, import charges, and other fees are not included in the product price unless expressly stated. These amounts may be calculated or displayed during checkout.
You authorize us and our payment processors to charge the payment method provided for the full amount of your order, including applicable taxes, shipping, and other charges.
We may correct pricing or product-information errors and cancel affected orders when permitted by law. If an order is canceled because of our pricing or listing error after payment has been collected, the applicable amount will be returned through the original payment method.
9. Discounts and Promotions
EG Artist does not offer discount codes or routine promotional pricing. Our prices reflect the time, hands-on work, emotion, care, artistic effort, materials, and precision invested in each piece.
No person, social-media account, third-party website, AI chatbot, or other source is authorized to promise a discount unless the offer is expressly published by Artist Emanuelle on egartist.com.
A pricing correction, merchant-issued credit required by law, or adjustment made to resolve a confirmed order error does not create an ongoing discount or promotional program.
10. Shipping and Delivery
Shipping charges are not included in the product price unless expressly stated. EG Artist does not offer free shipping.
Every order is prepared and packaged by hand with care and precision to help protect the artwork and collectibles during transit. Shipping charges help cover postage, packaging materials, handling, and the care required to prepare each order.
Available shipping services, estimated delivery times, and costs will be displayed during checkout based on the destination and available carrier services.
Express shipping may be available for an additional charge. Selecting express shipping changes the carrier’s estimated transit service; it does not necessarily shorten the time required to create, prepare, process, sign, serialize, inspect, or package an order.
Delivery dates are estimates and are not guaranteed. Carrier delays, weather, customs inspections, holidays, service disruptions, incorrect addresses, and circumstances outside our reasonable control may affect delivery.
Customers are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed delivery, or additional expenses caused by an inaccurate, incomplete, or outdated address supplied by the customer.
11. International Shipping
We offer international shipping to destinations supported at checkout.
International customers are responsible for reviewing their local import restrictions before placing an order. Customers are also responsible for customs duties, import taxes, brokerage fees, handling charges, and other fees imposed by the destination country or shipping carrier unless otherwise required by law.
International delivery estimates do not include customs-processing time. We are not responsible for delays caused by customs authorities, border inspections, local carriers, or other governmental processes.
We cannot falsify customs forms, reduce declared values, label commercial purchases as gifts, or otherwise provide inaccurate shipping or customs information.
If an international shipment is rejected, refused, abandoned, or returned because the customer did not pay required fees or comply with local import requirements, any action taken will be determined in accordance with applicable law and the circumstances of the shipment.
12. All Sales Are Final
Due to the limited-edition, artist-created, signed, serialized, personalized, handmade, and collectible nature of our products, all sales are final.
We do not accept:

Exchanges;

Customer-requested cancellations;

Buyer’s-remorse claims;

Requests based on a change of mind;

Requests based on reasonable handmade variations;

Requests based on natural copper toning or patina;

Requests based solely on differences between screen colors and the physical product; or

Requests because a customer no longer wants or needs the item.
Please carefully review all product descriptions, photographs, measurements, materials, edition information, prices, shipping charges, and order details before completing your purchase.
Signed, serialized, personalized, customized, handmade, hand-finished, and limited-edition products are not eligible for return or exchange.
Nothing in this section limits any consumer right or remedy that cannot legally be waived or excluded.
13. Order Problems, Damage, or Incorrect Items
Every order is carefully inspected and packaged before shipment. If you believe you received an incorrect item or an item was materially damaged during shipping, contact us promptly through the Contact Page on egartist.com.
Please retain the product, original packaging, shipping label, and all packing materials. We may request clear photographs of:

The exterior shipping package;

The shipping label;

The interior packaging;

The affected product; and
-
Any visible damage.
Providing this information does not guarantee a refund, replacement, or other specific resolution. Each reported issue will be reviewed based on the circumstances, available evidence, carrier requirements, product availability, and applicable law.
Limited-edition products may not be replaceable after they sell out. We do not guarantee that the same edition, artwork, serial number, signature placement, or accompanying item will be available as a replacement.
Do not return or mail any product without written authorization. Unauthorized returns may be refused.
14. Lost, Delayed, or Stolen Packages
Carrier delivery dates are estimates and are not guaranteed.
Once an order has been transferred to the shipping carrier, delivery may be affected by events outside our reasonable control. If tracking shows an unusual delay, contact the carrier and notify us through the Contact Page so the available information can be reviewed.
If tracking marks a package as delivered but you cannot locate it, please check the delivery area, household members, neighbors, property-management office, and local carrier before contacting us.
We do not guarantee reimbursement or replacement for packages that are confirmed as delivered by the carrier, stolen after delivery, misdirected because of an address provided incorrectly by the customer, or affected by circumstances outside our reasonable control, except where required by applicable law.
15. No Product Warranty or Guarantee
Unless expressly stated in a product listing or required by applicable law, our products do not include an extended warranty, service contract, or guarantee against changes caused by age, display, storage, handling, moisture, sunlight, temperature, chemicals, environmental exposure, or ordinary wear.
Copper art bars may naturally tone, oxidize, darken, spot, or develop a patina. Paper products, signatures, inks, prints, packaging, and display materials may also change over time depending on handling, storage, exposure, and environmental conditions.
Customers are responsible for properly storing, displaying, and caring for their purchases.
To the fullest extent permitted by law, products and Services are provided “as is” and “as available,” except for any express representations stated in the applicable product listing.
Nothing in this section excludes warranties or consumer protections that cannot legally be excluded.
16. Ownership and Intellectual Property
Unless otherwise stated, the website and its content—including original artwork, designs, illustrations, photographs, videos, product images, logos, graphics, written descriptions, poetry, packaging designs, branding, layouts, and other creative materials—are owned by or licensed to Artist Emanuelle and are protected by applicable intellectual-property laws.
Purchasing a physical product gives you ownership of that individual physical item only. It does not transfer copyright, trademark rights, reproduction rights, manufacturing rights, licensing rights, digital rights, or other intellectual-property rights in the artwork or design.
You may not reproduce, scan, copy, manufacture, mint, tokenize, modify, distribute, publish, sell reproductions of, license, commercially exploit, or use our creative materials to train artificial-intelligence systems without express written authorization from Artist Emanuelle.
You may photograph and display a lawfully purchased physical piece for personal, noncommercial purposes, provided that you do not falsely claim authorship, remove attribution, create reproductions for sale, or suggest an endorsement or partnership that does not exist.
Names, characters, titles, logos, games, programs, and other intellectual property belonging to third parties remain the property of their respective owners. References to third-party properties do not imply sponsorship, endorsement, authorization, or affiliation unless expressly stated.
17. Accuracy of Website Information
We make reasonable efforts to provide accurate and current information. However, information on the website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, edition details, or other content.
We reserve the right to correct errors, update information, or cancel affected orders when permitted by law.
Photographs and videos are provided to help represent our products, but colors, scale, finish, texture, brightness, and details may appear differently depending on lighting, photography, screen settings, and device type.
You are responsible for reviewing the complete product listing before purchasing.
18. AI-Assisted Chat
Our website may include an automatic AI-assisted chat service powered by Shopify. The chat service is intended to provide general information and help visitors navigate the website.
AI-generated responses may be incomplete, outdated, misunderstood, or inaccurate. Information provided by the AI-assisted chat does not modify these Terms, product listings, store policies, pricing, availability, shipping terms, or order details.

Unless we have entered into a separate written agreement, submitting an idea or suggestion does not create a confidential, fiduciary, employment, partnership, commission, or compensation relationship.
We are not obligated to keep unsolicited submissions confidential, develop a submitted idea, pay compensation, or respond.
We may remove content that we reasonably determine is unlawful, threatening, abusive, defamatory, obscene, fraudulent, misleading, invasive of privacy, infringing, or otherwise objectionable.
You may not submit content that violates copyrights, trademarks, privacy rights, publicity rights, or other rights belonging to third parties.

If these Terms conflict with a product-specific term expressly stated in a product listing, the product-specific term controls only for that product and only to the extent of the conflict.
Any ambiguity in these Terms will not be interpreted automatically against the party that drafted them.

These Terms and any separate agreements through which we provide Services are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.
Subject to any consumer rights or jurisdictional protections that cannot legally be waived, disputes relating to these Terms or the Services will be brought in a court of competent jurisdiction located in Bexar County, Texas.
Nothing in this section deprives a consumer of protections or legal rights that cannot be waived under the laws applicable to that consumer.
